Green People Recruitment introduces one or more candidates based on the available job profile. If you are interested in a candidate, you may invite them for an interview through us. Doing so means you agree to our terms of service

Article 1 Scope of Application

a. Recruitment and selection for direct employment is the service whereby Green People Recruitment selects and introduces one or more suitable candidates to the client, either verbally or in writing. A successful placement occurs when a candidate introduced by Green People Recruitment enters into employment with the client.

b. “Employment” also includes any comparable form of actual engagement of the candidate (e.g. as contractor, partner, seconded staff), whether via a third party or at a different branch or affiliated entity of the client.

c. A successful placement also includes any situation where the candidate, introduced by Green People Recruitment, enters into any form of employment with the client or an affiliated company within 24 months of the initial introduction, even if the assignment was withdrawn.

d. If the client or an affiliated entity offers the candidate an employment contract, verbally or in writing, within 24 months after the introduction, without informing Green People Recruitment within 14 days, a fee of four gross monthly salaries (excl. VAT) will be charged to cover costs.

e. Unless the client has explicitly reserved this in writing beforehand, the fee is also due if the candidate introduced by Green People Recruitment was already known to the client.

Article 2 Fees

a. A start fee is charged per vacancy. If the placement is successful, the start fee is deducted from the final invoice.

b. Upon a successful placement, Green People Recruitment will charge a fee of 25% of the candidate’s gross annual salary, plus applicable VAT.

c. The gross annual salary includes all remuneration and benefits the candidate will receive upon employment. For part-time roles or contracts shorter than a year, the fee is based on a full-time annual salary.

d. If agreed by all parties, the candidate may also be employed through Green People Recruitment on a temporary basis. The client may hire the candidate permanently after 6 months (1,040 hours) without additional cost. The interim rate is based on a fixed multiplier of the candidate’s gross hourly wage.

Article 3 Additional Costs

The client is not liable for any costs related to the execution of the agreement, other than the start fee and the placement fee upon successful fulfilment, unless expressly agreed otherwise in writing between Green People Recruitment and the client.

Article 4 Duty to inform

The client is required to provide Green People Recruitment with the candidate’s gross annual salary and start date within 14 days upon request. If this information is not provided, incomplete, or incorrect, Green People Recruitment reserves the right to estimate and invoice accordingly.

Article 5 Responsibility

Green People Recruitment commits to making every effort to recruit and select suitable candidates. The final decision to enter into an employment agreement lies with the client, who is also responsible for its content, salary, and working conditions. Green People Recruitment is not liable for any shortcomings or damages caused by the selected candidate.

Article 6 Confidentiality

The client may not disclose any information regarding candidates introduced by Green People Recruitment to third parties without prior written consent. Violation of this clause will result in an immediate penalty of €25,000 per breach, without prejudice to Green People Recruitment’s right to claim full compensation.

Article 7 Invoicing and Payment

a. The placement fee will be invoiced 14 days after the employment contract is signed.

b. Payment terms are 14 days from the invoice date. The client may not set off payments or suspend obligations. Failure to pay within the deadline constitutes default without further notice.

c. In the event of default, the client will owe an immediately payable interest charge of 2% of the outstanding principal per month, where part of a month counts as a full month.

Article 8 Governing Law and Disputes

These terms, as well as any assignment, request, or offer from Green People Recruitment, are governed exclusively by Dutch law. Any general terms and conditions of the client are excluded unless explicitly agreed upon in writing. In the event of a dispute, and if mutual resolution fails, either party may refer the matter to the competent civil court. The court of Roermond shall have jurisdiction.
